Regulatory Background

14 CFR Part 3, Subpart C, §3.301, 302, and 303

​

Applicability:

You need to assign a U.S. agent for service,

if you hold a Certificate issued under Part 61 (Pilots, Instructors), 65 (Mechanics), 67 (AMEs), or 107 (Remote pilots) and do not have a physical U.S. address on file with the FAA.

The Certificate holder’s responsibility is to:

  • Assign a U.S. agent for service through https://usas.faa.gov/, if required.

  • Make sure the agent for service understands the role and responsibility

  • Receive the consent of the agent for service to act as such

  • Inform the FAA about a change of agent for service inside of 30 days.

 

Effective dates:

  • For new Certificates or Ratings this rule is already in effect.

  • All Certificate holder need to comply by July 7, 2025

 

Non-compliance:

Individuals who are required but fail to designate a U.S. agent for service 

“…may not exercise the privileges of any certificate, rating, or authorization…”

That means, it would be a federal offense to use your Certificate with potential severe consequences.

Assigning an agent for service without knowledge and consent would also be a federal offense.
